Stupid Wish

Update (July 20, 2012): I have removed this image following a claim of copyright violation. I have asked for verification of the copyright in the image.

  2. I don't know who the model is. I've seen several photo sets with her, but I can't recall seeing a name.

  5. Sometimes the mention of the name of the model in an image is enough to get the copyright holders attention when they scan Google for places where the models name is mentioned. A way to sometimes avoid being detected in the process of having a copyrighted or alleged copyrighted image in use is to not name the model in the same blog.

  6. Unfortunately, her name was added by someone responding to a comment. I may have to start policing comments (yuck!) to keep this from happening again.

  7. Unless her name is owned by a corporation, a modeling agency, or an individual any copyright claim is frivolous. And even if it is unless you claim that the name in question is your own intellectual property, it is again frivolous and without grounds. So unless you said you came up with her name, I'd post the cap back up and tell them to take the stick out of their ass.

  8. Thanks, Daniel. However, the claim of copyright violation was in the use of the image, not the name. I suspect, as Anonymous suggested, that the model (or someone working for her or claiming to be her) came across this blog via a Google search on her name. Unless her name was trademarked I could use it freely (and even then, I could still use it in most circumstances), but the use of a copyrighted image is different. I could probably win a fair use argument, but it probably isn't worth the fight (especially to the extent it would require me to reveal more about me).
